CANADA ONLY. This warranty policy applies only in Canada. A separate warranty policy applies in the United States.

Manufacturer’s Limited Warranty

Nirvana Chauffe Piscine Inc. provides a limited warranty in the event of a defect affecting the operation of the pool heat pump itself. This warranty takes effect on the date of purchase, upon presentation of proof of purchase issued by the retailer, and applies only to new pool heat pumps intended for residential use, subject to the terms and exclusions set out in this policy. The pool heat pump must be installed in accordance with Nirvana’s specifications, used for its intended purpose and operated under the normal conditions described in the instruction manual applicable to the model.

Warranty Exclusions

• an inadequate electrical supply or an electrical supply that does not comply with the requirements of the instruction manual applicable to the model, including when the unit is not connected to a circuit breaker of sufficient capacity;
• abusive or negligent use;
• inadequate maintenance or maintenance not performed in accordance with the instruction manual applicable to the model;
• improper installation or installation performed by a person not approved by Nirvana Chauffe Piscine Inc.;
• damage caused by natural disasters or external events, including floods, earthquakes, tornadoes, hail, lightning or freezing;
• erosion of piping or internal components resulting, in particular, from improper pool closing or water conditions that do not comply with the manufacturer’s specifications;
• infiltration of sand or any other abrasive substance into the internal system of the unit, as well as any resulting damage or obstruction, including as a result of defective filtration equipment;
• premature corrosion of the titanium heat-transfer tube attributable to water conditions or the use of chemicals that do not comply with the manufacturer’s specifications, including pH, chlorine levels or salinity outside the recommended ranges;
• any modification, alteration, repair or replacement of parts performed by a person not approved by Nirvana Chauffe Piscine Inc.

Warranty Service and Repairs

During the warranty period, Nirvana Chauffe Piscine Inc. may, at its discretion, repair or replace any part deemed defective by a technician or representative approved by Nirvana, provided that the unit has been used under the conditions set out in this policy and the applicable instruction manual. Any warranty service call must be approved by Nirvana Chauffe Piscine Inc. Service must be performed by a qualified refrigeration technician. A repair performed by an unauthorized person may result in the manufacturer’s limited warranty being voided.

Applicable Rights and Limitations

The exclusions and limitations set out in this warranty apply subject to applicable laws. This limited warranty is in addition to any statutory warranties that may apply and does not replace them. Subject to applicable laws, Nirvana is not liable for incidental or consequential damages resulting from improper installation or use of the unit, or from the inability to use the unit. No other contractual warranty is provided by Nirvana unless otherwise stated in writing. No distributor or dealer is authorized to modify the terms of this warranty on behalf of Nirvana. Any additional warranty offered by a distributor or dealer is the responsibility of that distributor or dealer.

Original Purchaser and Warranty Transfer

This contractual warranty applies to the original purchaser of the product, except when a warranty transfer is approved by Nirvana in accordance with the conditions below. Proof of purchase must be provided for any warranty claim. The warranty may be transferred to a new owner upon the sale of a residence in which a Nirvana pool heat pump is installed, subject to an inspection of the unit by a Nirvana technician and approval of the transfer. The inspection is intended to verify the condition of the unit before the request is processed. Warranty transfer fees apply. They include a fixed fee determined according to one of two situations: an installed unit or a relocated unit. Service and travel fees will also apply. The applicable fees are those in effect at the time of the transfer request and will be communicated before the request is processed.

Service Request, Under Warranty or Out of Warranty

Preparing for the Technician’s Visit

• ensure that the property and access to the unit are clear and accessible to the technician;
• clear the area around the pool heat pump;
• ensure that the pool heat pump is connected to electricity, unless otherwise instructed by Nirvana;
• ensure that no dog or other animal is loose in the service area;
• ensure that an adult 18 years of age or older is present if the technician needs access to a private area.
